A trial date has officially been set for Emporia State tennis player Dominik Simunovic, 21, in the case of an alleged rape and attempted aggravated criminal sodomy that took place last October.
Simunovic was arrested on Oct. 17 after he was reported to be the perpetrator of an alleged rape that took place in the alley behind Bourbon Cowboy on Oct. 14. At his preliminary hearing earlier this month, Senior Judge Merlin Wheeler ruled there was enough probable cause in Simunovic’s case to proceed to trial.
Requests for the court to lift Simunovic’s GPS monitoring have now been denied twice. At Simunovic’s pretrial hearing Friday, Chief Judge Jeffry Larson denied the defense’s second request to remove the monitoring device and determined that all of his bond conditions will remain.
Simunovic’s final pretrial hearing is scheduled for May 8 and his trial is set to begin on May 13.
